Todd Ole Burris, 36, of Frazee, the man who was shot by law enforcement at the Frazee rest area on Wednesday, July 9  has been charged with seven felonies, including attempted murder.

According to the criminal complaint, authorities responded to a domestic disturbance in rural Becker County around 5:30 p.m. on July 9. The complainant reported that Burris had assaulted her, slashed her tires, stolen a firearm and fled the scene.

Deputies located the vehicle Burris was driving and he allegedly fled from officers at speeds in excess of 100 mph. Burris eventually pulled into the Frazee rest area east of town. According to the deputies, Burris pointed a handgun at one of the deputies and an exchange of gunshots occurred.

Burris suffered gunshot wounds to both of his legs in the exchange and was taken to a Fargo hospital. 

No other injuries were reported.

Burris faces two counts of first-degree attempted murder of a peace officer, two counts of first-degree assault against a peace officer, two counts of second-degree assault and one count of fleeing.

The deputies who fired weapons were identified as Becker County Sheriff’s Office Lt. Luke Sweere, who has 26 years of law enforcement experience, and Detroit Lakes Police Officer Philip Vaughn, who has 16 years of law enforcement experience. 

Both have been placed on critical incident leave, standard procedure following a shooting.

Burris made his first court appearance on Tuesday, July 15 and is scheduled to return for an omnibus hearing on Monday, Aug. 11.
